UDENSI, UKAEGBU'S WOE COMPOUNDED AS COURT FAILS TO HEAR THEIR MOTION TODAY

It was further gloom in the camp of Chikwe Udensi and Ukaegbu's camp today as the Umuahia High Court, adjourned hearing of the motion to set aside the stay of Execution of the Interlocutory order upon which Prince Nnanna Ukaegbu purportedly recognized himself as the Chairman of APGA in the State.

The faction had approached the Court today to set aside the stay of execution which the Court had granted after listening to the argument of Ken Ahia, SAN for APGA and Anagha Kalu, Esq for Nnanna Ukaegbu. The Court in its ruling delivered on 6/2/2019 stayed execution of the order of Interlocutory Injunction granted by Justice Okorafor. By the stay of that order Nnanna Ukaegbu lost the basis upon which he is claiming to be the Chairman and can actually be held in contempt of the Court.

In the ruling, a copy of which was obtained by us, the Court noted APGA has valid grounds of Appeal, on points of Law especially since Ukaegbu claims that his tenure will expire in 2015 in the suit he filed in 2014.

In view of the ruling all the candidates who claimed Victory through primaries concluded by Ukaegbu as the Chairman automatically lost out.

Perhaps, this prompted the application of Ukaegbu to the same Court to set aside the stay of execution. Ukaegbu's Lawyer argued that the matter was a pre-election matter, while the Lawyer representing APGA said it was not, but just about suspension as a Chairman and also that the Appeal was before the Court of Appeal Owerri.

The Court agreed with the APGA Lawyer and adjourned the argument to 6th March, 2019.
