The Lagos State High Court has released the complete judgment in the high-profile defamation case involving Senior Advocate of Nigeria (SAN), Kenneth Chukwuemeka Ahia, and Facebook user, Ikechukwu Iroha Agwu - and the revelations are damning.

Presided over by Justice O. Atinuke Ipaye, the Court delivered a hard-hitting verdict, concluding that Agwu was indeed the author and publisher of a series of defamatory posts circulated under the Facebook identity "Ikechukwu Iroha.ÔÇØ The Court described the posts as malicious, false, reckless, and deliberately crafted to damage the reputation of the respected Senior Advocate.

Justice Ipaye ruled that the claimant presented "overwhelming, unchallenged and consistentÔÇØ evidence linking Agwu to the posts made on July 10, 11 and 15, 2023 - posts that falsely alleged that SAN Ahia benefited improperly from government contracts.
While the defendant attempted to distance himself from the account by claiming that "mischief makersÔÇØ opened fake Facebook profiles to impersonate him, the Court dismissed his defence, declaring his evidence inadmissible and lacking credibility.

The judgment emphasized a critical point in digital investigations:

"Whilst a Facebook account holder may change his name or handle, the weblink remains irrevocably tied to the account holder. The Facebook URL in evidence clearly linked the posts to the defendant.ÔÇØ

Beyond documentary evidence, the Court also relied on a video tendered as Exhibit 14, where Agwu openly mocked the SAN even after receiving a formal demand letter. Justice Ipaye described the conduct as disrespectful, malicious and intolerable for any individual, let alone one involved in active litigation.

The Court ruled that the Facebook publications were "false, libelous and intended to lower the claimant's standing before right-thinking members of society,ÔÇØ stressing that reputation remains one of the most valuable assets an individual must protect.
Consequently, the Court granted all reliefs sought. Agwu was ordered to:

Publish a full retraction of the libelous posts
Tender an unreserved apology within seven days
Pay 20 million in general damages
Pay 500,000 costs

"A person is entitled to his reputation and good name. Having been unjustifiably maligned, the claimant is entitled to damages and a full vindication of his character.ÔÇØ
Legal analysts say this ruling strengthens the growing trend of Nigerian courts imposing stiff penalties on individuals who weaponize social media to spread falsehoods, defamation or malicious propaganda.
