The Federal High Court in Abuja, on Wednesday, February 21, 2025, refused to grant an ex-parte request by Senator Samuel Anyanwu, the embattled National Secretary of the Peoples Democratic Party (PDP), seeking to prevent the Independent National Electoral Commission (INEC) from recognizing his removal from office.

In a session presided over by Justice Inyang Ekwo, the court ruled that while Anyanwu had established a case of urgency, he could not obtain an immediate order restraining INEC without giving the commission and other parties the opportunity to present their case.

Justice Ekwo, rather than granting the ex-parte injunction, directed Anyanwu to serve legal notices to INEC and the PDP Acting National Chairman, Ambassador Umar Illiya Damagun, summoning them to court to present their defense before any ruling could be made.

Senator Anyanwu, through his lawyer K.C.O. Njemanze (SAN), had urged the court to issue an interim injunction barring INEC from accepting any correspondences or documents from the PDP unless they were signed by him.

Additionally, he sought an order preventing Ambassador Damagun from communicating with INEC or submitting any party-related documents without his authorization.

However, Justice Ekwo refused to issue an immediate injunction, instead opting to hear from both INEC and Damagun before making any ruling. He directed Anyanwu to formally notify them of the lawsuit and scheduled February 24, 2025, for the hearing.
The rejection of his ex-parte request means that, for now, INEC can proceed with recognizing his removal as PDP National Secretary. However, the case remains open, and the court will determine the legality of his ouster after hearing from all parties involved.
